Terms of Service
Welcome to BagProof. These Terms of Service ("Terms") govern your use of the BagProof mobile application and related services ("Service") operated by BagProof ("we," "our," or "us").
Acceptance of Terms
By accessing or using BagProof, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Service Description
BagProof is an order documentation platform designed for restaurants. The Service allows you to:
- Capture photos and videos of delivery orders before handoff
- Store timestamped proof of order contents
- Generate shareable proof links for dispute resolution
- Manage staff and location records
BagProof does not guarantee resolution of delivery disputes. We provide documentation tools; outcomes depend on delivery platform policies.
User Accounts
To use BagProof, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
You must be at least 18 years old to create an account. Accounts are for business use and may not be shared or transferred without permission.
Subscription & Billing
BagProof offers subscription plans with the following terms:
- Free Trial: New accounts receive a limited free trial with restricted order captures.
- Paid Plans: Subscription fees are billed monthly or annually based on your selected plan.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled.
- Cancellation: You may cancel at any time through the App Store, Google Play, or within the app. Cancellation takes effect at the end of the current billing period.
- No Refunds: Subscription fees are non-refundable except where required by law.
Payment processing is handled by RevenueCat and the respective app stores. We do not store your payment information directly.
User Content
You retain ownership of photos, videos, and other content you upload to BagProof ("User Content"). By uploading content, you grant us a limited license to:
- Store and process your content to provide the Service
- Generate shareable proof links as directed by you
- Create thumbnails and previews for display within the app
User Content is automatically deleted 30 days after capture. You are responsible for ensuring you have the right to upload any content.
Prohibited Uses
You agree not to use BagProof to:
- Upload false, misleading, or fraudulent content
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated systems to access the Service without permission
- Record individuals without their knowledge where prohibited by law
We reserve the right to suspend or terminate accounts that violate these terms.
Limitation of Liability
To the maximum extent permitted by law:
- BagProof is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
- We do not guarantee that the Service will be uninterrupted or error-free
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.
Termination
You may terminate your account at any time by contacting us or using the account deletion feature in the app.
We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. Upon termination:
- Your right to use the Service ends immediately
- Your User Content will be deleted within 30 days
- Any outstanding fees remain due
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.
